Why You Need an LPA
All too often, a family member or loved one sadly loses their ability to manage their affairs with no plan in place for their finances, property, health or welfare to be dealt with on their behalf. This loss of mental capacity can happen at any stage in life, whether through illness, disease, brain injury, side effects of medication, a progressive learning disorder, mental health problems, drug/alcohol misuse, or the natural ageing process.
Whilst we are all living longer, sadly this doesn’t necessarily mean in good health. According to the Alzheimer’s Society, an additional 225,000 people in the UK will develop dementia each year, in addition to the 850,000 who are currently suffering from the illness. This is now Britain’s biggest killer. However, it is not just an age concern. Some 40,000 people under the age of 65 have dementia in the UK. Putting it bluntly, one person in the UK develops dementia every 3 minutes.
If left too late without first ensuring that you have made (and registered) your chosen LPA(s), those looking after you must go to court to get the authority to act on your behalf. This can be a complex and time consuming process which is often stressful, and it will not always be to the benefit of you or your loved ones. Not having an LPA in place therefore not only causes a delay in implementing your wishes for your future, with additional worry and strain placed upon your loved ones, but the associated court/legal fees are high: £400 to register a Deputy, £500 for the hearing fee, approximately £1,000 in legal costs, plus an annual supervision fee of £320.
By creating the LPA now, whilst you have full mental capacity, you're not only protecting your future, but you’re making life a lot simpler, cheaper and far less complicated for those closest to you.
How we can help you
Here at the LPA Advice Company, we understand how difficult it can be to think about your future needs, but also how important it is to have a plan in place to ensure that your financial and health affairs are properly looked after if and when the times comes that you are unable to do so by yourself.
We will expertly draft your personally tailored LPA for you, ensuring it complies with the law in this area and that any preferences and instructions you have requested are acceptable by the Office of the Public Guardian (OPG). Although there are a wide range of companies offering to draft your LPA for you, with free services also available, many LPAs fail to be accepted by the OPG due to poorly worded instructions and preferences. A poorly drafted LPA can also be easily challenged by disgruntled family members. Equally, the choice of Attorney can result in legal disputes, years later.
NB: Many companies charge an additional fee for this ‘checking service’, but here at the LPA Advice Company, the checking service is included in our fixed fee.
You will receive our full support until you are happy with the products we have sent you. We will then provide you with free step by step guidance to enable you to more easily navigate the complex registration process to ensure no points are missed and avoid the usual pitfalls which typically result in the OPG rejecting an LPA at the last stage.
All you have to do is complete our easy online questionnaire, found at the top of this page. Should you require any assistance, our dedicated advisors, who are all experienced legal professionals, are on hand to explain the legal issues involved in plain English and assist you in understanding the process involved in making what are often very difficult decisions.
Our expert service is provided at a fraction of the cost of a high street solicitor. There are no hidden extras, just a one off fixed fee.
Ready to get your LPA?
The LPA Advice Company made the process of completing both of my LPA’s simple and straight forward. More importantly, they saved me several hundred pounds in comparison to the quotes I received from my Solicitor. A huge thumbs up from me!
